Terms of Service

These Terms cover your account, acceptable use, subscriptions and billing, the content you submit, the limits of AI outputs, and how either side can end the agreement.

1. Agreement and Eligibility

These Terms of Service ("Terms") are an agreement between you andWave Vision. You accept these Terms when you check the acceptance box during signup or checkout, or when you continue using the service after receiving legally sufficient notice of an updated version. If you do not agree, do not use the service.

You must be legally able to enter a contract. The service is not directed to children under 13. If you use the service for a company or client, you represent that you have authority to bind that organization.

2. The Service

Wave Vision provides tools that may include:

  • Cross-platform social-media analytics and performance reporting.
  • Vision Score and related scoring or benchmarking features.
  • AI-assisted content analysis, recommendations, pattern detection, script or storyboard assistance, and planning tools.
  • Authorized connections to social platforms and related data providers.
  • Account, billing, support, and communication features.

Features, limits, integrations, and availability may change. Social platforms are independent third parties and may change, limit, or discontinue their APIs or permissions.

3. Accounts and Security

  • Provide accurate account information and keep it current.
  • Protect your credentials and notify us promptly if you believe your account is compromised.
  • Accept responsibility for activity conducted through your account, except to the extent caused by our failure to use reasonable safeguards.
  • Connect only accounts and content you are authorized to access.

We may require information needed to verify a payment, prevent fraud, or recover an account. We may suspend access while investigating a security or abuse concern.

4. Acceptable Use

You may

  • Use the service for lawful analytics, planning, and content work.
  • Connect accounts you control or are authorized to manage.
  • Use and share your own reports and outputs responsibly.
  • Use the service for internal business or client work, subject to your client obligations.

You may not

  • Break the law, violate another person's rights, or violate a social platform's terms.
  • Probe, disrupt, overload, scrape, reverse engineer, or bypass limits or security controls.
  • Upload malware, credentials, unlawful content, or content you do not have permission to process.
  • Share credentials, impersonate another person, or use the service to build a competing service from unauthorized data.
  • Use automated access except through an authorized Wave Vision feature or written permission.

5. Subscriptions, Trial, and Billing

Current offers

The checkout and pricing page control the offer presented to you. The current codebase describes a 30-day trial for $1, followed by a monthly subscription currently shown as $37/month. The pricing page also contains a $247/year annual plan. If the checkout page shows a different price or plan, that checkout disclosure controls.

Auto-renewal

Unless you cancel before the renewal date, a subscription renews for the same billing period and the payment method on file is charged the price shown at checkout, plus applicable taxes. The trial disclosure is presented next to the relevant purchase controls. Stripe processes the payment and provides the billing record.

Cancellation and refunds

  • You may cancel through account settings or the Stripe billing portal. Cancellation stops the next renewal; access generally continues through the paid period unless the account is suspended or terminated for a permitted reason.
  • Except where required by law or expressly stated at checkout, charges are non-refundable. The current pricing page does not create a separate money-back guarantee unless that offer is removed or made accurate.
  • A failed payment may result in retry, restricted access, or suspension after reasonable notice.
  • We may change prices or plan features with advance notice where required. A price change will not silently alter a paid period already in progress.

6. Your Content and Our License

You retain ownership of content and data you submit or authorize us to access. You grant Wave Vision a limited, non-exclusive license to host, copy, transmit, transform, analyze, and display that content only as needed to provide, secure, improve, and support the service, or as otherwise described in the Privacy Policy.

You represent that you have the rights and permissions needed for us to process the content and that your content does not violate law, a third party's rights, or a connected platform's rules. The license ends when the content is deleted or the account is closed, except for backups, security records, legal records, or aggregated information that cannot reasonably identify you.

7. AI Outputs and No Professional Advice

AI outputs, scores, predictions, recommendations, transcripts, and analyses are generated from available data and may be incomplete, delayed, or wrong. They are suggestions for your review, not guarantees of reach, revenue, growth, performance, or business results, and they are not legal, financial, medical, tax, or other professional advice. You are responsible for reviewing outputs before relying on or publishing them.

8. Wave Vision Intellectual Property

Wave Vision owns or licenses the service, software, branding, interfaces, scoring methods, templates, and non-user materials. These Terms grant you a limited right to use the service while your account is permitted to access it. You may not copy, sell, sublicense, publish, or create derivative works from Wave Vision materials except as allowed by law or written permission.

Feedback is voluntary. If you provide feedback, you allow us to use it without restriction or payment, provided we do not identify you publicly without permission.

9. Privacy and Data

Our Privacy Policy explains how we collect and use information. It is part of these Terms for privacy-related obligations, but it does not expand the promises we make beyond the actual service and controls described in the policy.

10. Third-Party Services

The service depends on third-party providers, including payment, hosting, authentication, analytics, AI, and social-platform providers. Their services may have separate terms and privacy policies. Wave Vision is not responsible for a third party's independent acts, outages, policy changes, data practices, or content, although we will make reasonable efforts to maintain supported integrations.

11. Suspension and Termination

You may stop using the service at any time. We may suspend or terminate access for nonpayment, material breach, fraud, abuse, security risk, legal requirement, or a material operational reason. We will provide notice where practical and required. On termination, access ends and data is handled under the Privacy Policy and applicable retention obligations.

12. Disclaimers and Liability

Service disclaimer

To the maximum extent permitted by law, the service is provided on an "as is" and "as available" basis. We disclaim warranties that the service will be uninterrupted, error-free, secure, or accurate, and we do not guarantee a particular business result. Nothing in these Terms excludes a warranty or right that applicable law does not permit us to exclude.

Liability limit

To the maximum extent permitted by law, Wave Vision's total liability for claims arising from or related to the service will not exceed the greater of the amounts you paid to Wave Vision for the service during the twelve months before the event giving rise to the claim or $100. This limit does not apply to liability that cannot legally be limited, including fraud, willful misconduct, or other non-waivable rights. Neither party will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages to the extent permitted by law.

Indemnification

To the extent permitted by law, you agree to defend and indemnify Wave Vision from third-party claims arising from your unlawful use of the service, your content, your violation of these Terms, or your violation of another person's rights. This obligation does not require you to indemnify us for our own fraud, willful misconduct, or liability that cannot legally be shifted.

13. Governing Law and Disputes

California law governs these Terms without regard to conflict-of-law rules, except where a consumer-protection law requires otherwise. Subject to applicable law, disputes that are not resolved informally may be brought in state or federal courts located in San Francisco County, California, and each party consents to that venue. We have not added an arbitration or class-action waiver to this version.

14. Changes to These Terms

We may update these Terms when the service, pricing, law, or business changes. We will publish a fixed version and effective date, preserve prior versions where practical, and provide additional notice or require renewed acceptance for material changes when appropriate. Continued use after legally sufficient notice may constitute acceptance; material changes will not rely solely on a hidden or silently changing page.
